1. Who you are contracting with
These Terms & Conditions (the "Terms") form a binding agreement between you and Course Crow AI ("Course Crow AI", "we", "us", "our") governing your access to and use of our website, software, and related services (the "Service").
2. Acceptance
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. The Service
Course Crow AI is an AI-assisted e-learning studio. It generates, edits, and exports interactive courses (including avatar-led video, slides, narration, quizzes, and SCORM packages) from prompts, files, or other inputs you provide. Specific capabilities depend on your plan.
4. Your account
You must provide accurate registration information and keep it current. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us promptly at pinkprotocolai@gmail.com of any unauthorized use.
5. Acceptable use
You must not misuse the Service. In particular you must not:
- use the Service for any unlawful, fraudulent, or deceptive purpose, or to send spam;
- infringe any intellectual property, privacy, publicity, or other rights of any person;
- upload malware, attempt to probe, scan, or test the vulnerability of the Service, or interfere with its security or integrity;
- scrape, crawl, reverse engineer, decompile, or attempt to extract source code, models, or underlying data;
- resell, sublicense, or redistribute the Service except as expressly permitted; or
- circumvent any usage limits, paywalls, or technical restrictions.
6. AI-generated content
The Service uses generative AI models to produce courses, narration, images, and related outputs. You are responsible for: (a) the prompts and inputs you provide; (b) ensuring you have the rights to any content you upload; (c) reviewing outputs before publishing or distributing them; and (d) how you use outputs.
You must not use the Service to generate illegal content, hateful or harassing content, sexual content involving minors, deepfakes intended to deceive, content that incites violence, malware, or content that infringes others' rights. You must not attempt to jailbreak or bypass safety controls.
AI outputs may be inaccurate, incomplete, or biased. The Service is not a substitute for qualified professional advice (medical, legal, financial, regulatory, etc.) and outputs should be reviewed by a qualified person before being relied upon in regulated contexts.
We may, at our discretion, refuse, filter, or remove outputs and may suspend accounts that repeatedly produce violating content. We respond to credible rights-holder complaints and may remove infringing content and terminate repeat infringers.
7. Your content
You retain ownership of the content you upload and the courses you create. You grant Course Crow AI a limited, worldwide, non-exclusive license to host, store, process, transmit, and display your content solely to provide and improve the Service for you.
8. Our intellectual property
Course Crow AI and its licensors retain all right, title, and interest in and to the Service, including the software, models, templates, documentation, branding, and any improvements. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your plan and these Terms. No other rights are granted by implication or otherwise.
9. Payment, billing, and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. By placing an order you also agree to Paddle's Buyer Terms, which govern payment, billing, taxes, cancellations, and refunds.
Subscriptions renew automatically at the end of each billing period until canceled. You can cancel at any time from your account or via Paddle; cancellation takes effect at the end of your current paid period.
10. Service availability
We work hard to keep the Service running, but we do not guarantee that it will be uninterrupted, timely, secure, or error-free. We may modify, suspend, or discontinue features at any time. Planned maintenance, third-party outages, and force-majeure events may affect availability.
11. Suspension and termination
We may suspend or terminate your access to the Service, with or without notice, for: (a) material breach of these Terms; (b) non-payment; (c) suspected fraud, abuse, or security risk; or (d) repeated or serious policy violations. You may stop using the Service at any time. On termination, your right to use the Service ends and we may delete your data after a reasonable export window.
12. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
13. Limitation of liability
To the fullest extent permitted by law, Course Crow AI's total aggregate liability arising out of or relating to the Service or these Terms will not exceed the fees you paid to us in the twelve (12) months before the event giving rise to the claim. We will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be excluded by law.
14. Indemnification
You agree to indemnify and hold harmless Course Crow AI from any claim, loss, or expense (including reasonable legal fees) arising out of: (a) content you upload or generate; (b) your unlawful use of the Service; or (c) your breach of these Terms.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use after the effective date constitutes acceptance.
16. Governing law
These Terms are governed by the laws of the jurisdiction in which Course Crow AI is established, without regard to conflict-of-laws rules. The courts of that jurisdiction will have exclusive jurisdiction over any dispute, except that we may bring proceedings to enforce intellectual property rights in any competent court.
